Call recording consent
Call recording consent is the permission the law requires before a phone call is recorded; in California, every party to a confidential call must be told and agree, which is often called two-party consent.
01 In depth
What it is, why it matters and what to ask a vendor
Federal law allows a call to be recorded when one party consents. California goes further: Penal Code section 632 makes it an offense to record a confidential communication, including a telephone call, without the consent of all parties. In practice businesses satisfy this with a clear announcement at the start of the call, and the caller consents by staying on the line.
This matters more now that AI voice agents and meeting assistants record and transcribe routinely. A growing business with customers in several states should apply the strictest rule everywhere rather than guessing where the caller is. The announcement also builds trust when it is paired with honest disclosure that the caller is speaking with an AI.
Ask any vendor where the recording notice plays, whether it can be changed, where recordings and transcripts are stored and for how long, who can access them, and how a customer can request deletion. Confirm your wording and retention policy with your attorney; this entry is a definition, not legal advice.
